SIGNING OF BILATERAL AGREEMENT

SIGNING OF A BILATERAL AGREEMENT BETWEEN THE GUARANTEE FUNDS MANAGED BY BAAR and BNAA ON THE PROTECTION OF VISITORS

On 06.11.2024, in Chisinau, the Bilateral Agreement between the Guarantee Funds on the protection of visitors between the Romanian Motor Insurers' Bureau (BAAR) and the Moldovan National Motor Insurers' Bureau (BNAA) was signed.


The purpose of the aforementioned Agreement is to protect visitors from both states, under conditions of reciprocity, in order to benefit from compensation for damages suffered as a result of accidents caused by uninsured or unidentified motor third party liability (RCA) vehicles, registered in one of the signatory states, Romania or the Republic of Moldova. In other words, according to the signed Agreement, each party undertakes to compensate citizens and residents of the country of the other party, who suffered damages as a result of an accident caused by an uninsured or unidentified vehicle in the country of the first party, under the same conditions under which it would compensate its own citizens and/or residents.


It should be noted that, BNAA grants, in accordance with Law no. 106/2022 on compulsory motor third party liability insurance for damage caused by vehicles, compensation under the aforementioned conditions without distinguishing whether the injured parties are citizens/residents of the Republic of Moldova or of other states, which is not valid on the territory of Romania - an EU member state and from whose Guarantee Fund managed by BAAR only EU residents can benefit, according to the applicable law.


Therefore, the provisions of the Agreement concluded by BNAA with the counterpart office in Romania will benefit drivers, citizens/residents of the Republic of Moldova who are injured on the territory of Romania, in the event that they are involved in road accidents caused by vehicles registered in Romania without a valid/unidentified RCA insurance policy, which was impossible to achieve until the current stage. Accordingly, drivers who are citizens/residents of the Republic of Moldova (non-EU) and who have suffered damage in Romania under the aforementioned conditions, upon returning to the Republic of Moldova, may contact the BNAA for assistance, where they will be guided on the actions necessary to be taken further.
