MISSION OF
THE FUND

Fund Objective

We protect victims of road accidents caused by unidentified / illegally obtained vehicles or for which a valid MTPL insurance has not been issued at the date of accident, as well as for deregistered or not registered vehicles on the territory of the Republic of Moldova.

Contributions to the Fund

The fund consists of the mandatory monthly contribution of MTPL insurers and represents 1% of the domestic MTPL written insurance premiums.

Damages covered in case of an unidentified/illegaly obtained vehicle

If the accident was caused by an unidentified vehicle or illegally obtained and MTPL uninsured vehicle, compensation is granted to the injured party for personal injuries or death and not for material damage. If an unidentified vehicle accident caused death or bodily injury that led to the disability, compensation is also paid for the material damage caused to the injured person with the equivalent in lei of the amount exceeding EUR 200, and in the case of the vehicle obtained illegally and without mandatory MTPL insurance - the insurance indemnity is paid for bodily injury or death, and for material damage caused to the person with the equivalent in lei of the amount exceeding EUR 100.

Damages covered in case of lack of MTPL insurance

If the driver of the vehicle that caused the accident is not insured for internal civil liability, compensation is granted to injured party for material damage, personal injuries or death.

Exclusions from compensation

Persons who voluntarily boarded the vehicle responsible for the accident, if it is proved that they knew the driver of the vehicle is not insured for internal motor third party liability insurance, or they have the possibility to recover the suffered damages based on an optional insurance, can not receive compensation from the Street Victims Protection Fund.

Amount of damageT

The amount of damages suffered by the injured party is established in accordance with the provisions of Law No.106 of 21.04.2022 on compulsory civil liability insurance for damage caused by motor vehicles and the normative acts issued in this respect, which shall not exceed the maximum limits of compensation provided in the legislative act.

Compensation limits

Compensation limits are:
EUR 100 000 - for damages or destruction of the property, regardless of the number of people injured in an accident;
EUR 100 000 - for each person injured in case of personal injury or death, but not more than EUR 500 000, regardless of the number of persons injured in an accident.
EUR 5 000 – moral damages resulting from the disability or death of the injured person caused by one and the same accident for one injured person or EUR 10 000 – for several injured persons.

Claim for compensation

The natural and/or legal persons considering that they have the right to benefit from Street Victims Protection Fund indemnities, will submit a claim in address of the National Bureau of Motor Insurers.

Identity card of the injured person

Medical documents regarding bodily injuries/death, as the case may be

Refusal of the MTPL insurer to indemnify the injured party, as the case may be

Vehicle registration certificate

Documents issued by legal institutions regarding the circumstances of the road accident/amicable statement form

Power of attorney and identity card of the representative, as the case may be

PERSONAL DATA PROTECTION

Article 1

NBMIM has high-performance informational security systems that ensure the confidentiality of the personal data in strict accordance with the Security Policy on the processing of personal data within the NBMIM.

Article 2

The processing of personal data is carried out by the NBMIM for the purpose of exercising the duties of the service in the field of management and regularization of damages according to the competences.

Article 3

The processing of personal data is carried out by internal users and contracted persons directly involved in the technological processes of data processing and use.

Article 4

The collection of personal data is carried out for specific, explicit and legitimate purposes, in compliance with the legal security and confidentiality measures according to the legislation in force.
